These Terms of Service govern your use of the Dromana Drive-In website and your purchase of tickets, food and beverages, gift cards and other products or services offered by Dromana Drive-In.

Please read these Terms of Service carefully before using our website or purchasing products or services from us.

By accessing or using our website, creating an account, submitting information, or purchasing a product or service from Dromana Drive-In, you agree to be bound by these Terms of Service.

If you do not agree to these Terms of Service, you must not use our website or purchase products or services through it.

These Terms of Service are governed by Australian law, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

 

1. Application of these Terms of Service

These Terms of Service apply to:

  • purchases of movie tickets;
  • purchases of food and beverages from Shel's Diner where purchased online or in store;
  • purchases of gift cards;
  • renting of equipment;
  • creation and use of customer accounts;

  • any other products or services expressly stated to be subject to these Terms of Service.

5. Submitted Data and Comments

5.1

You may have the opportunity to submit reviews, comments, photographs, videos, feedback, testimonials or other material to Dromana Drive-In.

5.2

You remain responsible for material that you submit.

5.3

By submitting material to us, you represent that:

  • you have the necessary rights and permissions to submit the material;
  • the material does not infringe another person's intellectual property, privacy or other rights;
  • the material is not unlawful, defamatory, threatening, abusive, obscene or otherwise inappropriate;
  • the material is not misleading or fraudulent; and
  • the material does not contain malicious software or other harmful code.

5.4

You grant Dromana Drive-In a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, communicate, adapt and display material you submit for purposes associated with operating, promoting and improving Dromana Drive-In and its services.

5.5

Where appropriate, we may attribute submitted material to you using the name or username associated with the submission.

5.6

We may, but are not obliged to, review, moderate, edit, remove or refuse to publish submitted material.

5.7

We may remove material where we reasonably believe that it breaches these Terms of Service, applicable law or our standards.

5.8

You should not submit confidential, sensitive or personal information through public review or comment functions.

 

6. Movie Ticket & Shel's Diner Purchases

6.1 General

Tickets, food, beverages and other products may be purchased through our website, in person, or other approved sales channels.

6.2 Ticket availability

Movie sessions, seating or vehicle capacity may be subject to availability.

We do not guarantee that tickets will remain available until you complete your purchase.

6.3 Ticket confirmation

A purchase is not complete until payment has been successfully processed and a booking confirmation or ticket has been issued.

You should retain your booking confirmation and present it when requested.

6.4 Ticket pricing

Ticket prices are displayed at the time of purchase.

Prices may vary depending on factors including:

  • movie;
  • date;
  • session;
  • age category;
  • special events;
  • promotions;
  • school holidays; and
  • other applicable pricing arrangements.

6.5 Session changes and cancellations

We reserve the right to change or cancel a movie session where reasonably necessary, including because of:

  • severe weather;
  • safety concerns;
  • technical problems;
  • film distribution issues;
  • equipment failure;
  • operational requirements;
  • circumstances beyond our reasonable control; or
  • other circumstances affecting the operation of the venue.

Where a session is cancelled by Dromana Drive-In, we will provide any refund, credit, replacement ticket or other remedy applicable to the circumstances and required by law.

6.6 Movie substitutions

Where a particular movie becomes unavailable due to circumstances outside our reasonable control, we may substitute another movie or take other reasonable steps.

Where a substitution materially affects your booking, we will provide any remedy required under applicable law.

6.7 Late arrival

Customers should arrive with sufficient time to enter the venue and locate their designated area before the advertised movie commencement time.

Late arrival may affect your ability to enter safely or may require you to follow directions from venue staff.

6.8 Food and beverage orders

Food and beverage availability is subject to stock and operational capacity.

Where an item purchased online is unavailable, we may offer a suitable replacement, refund or other appropriate remedy.

6.9 Alcohol

Where alcoholic beverages are sold, additional age-verification and responsible service requirements apply.

We may refuse service where required or permitted by law.



7. Gift Card Purchases

7.1

Dromana Drive-In may offer physical and/or digital gift cards.

7.2

Gift cards may only be redeemed in accordance with the terms applicable to the gift card.

7.3

Gift cards are not redeemable for cash except where required by law.

7.4

Gift cards must not be resold or used for unauthorised commercial purposes without our permission.

7.5

You are responsible for keeping gift cards and gift card codes secure.

We are not responsible for unauthorised use of a gift card where the gift card or redemption details have been lost, stolen or disclosed.

7.6

Gift cards expire 3 years from the date of issue. Any applicable expiry date will be disclosed at the time of purchase. Any unused amounts after the expiry date will not be credited or refunded. Gift cards will not be extended unless otherwise agreed upon.

7.7

Specific gift card terms may apply and will be made available at the time of purchase.

7.8

Nothing in these Terms of Service limits any rights you may have under the Australian Consumer Law.

 

8. Equipment Hire

8.1

Dromana Drive-In may make equipment available for hire or temporary use by customers, including but not limited to audio equipment, speakers, FM transmitters, radios, headphones, equipment accessories, chairs and other items designated by Dromana Drive-In.

8.2

Equipment remains the property of Dromana Drive-In at all times unless expressly stated otherwise.

8.3

Equipment hire may be subject to a hire fee, security deposit, identification requirement or other conditions specified at the time of hire.

8.4

Before equipment is released, Dromana Drive-In may require the customer to provide:

  • valid physical government-issued photo identification for verification purposes; or
  • another form of security deposit acceptable to Dromana Drive-In.

Acceptable identification or security may include a driver's licence, passport or other government-issued photo identification.

8.5

Where physical identification is provided for verification or security purposes, Dromana Drive-In will handle that identification in accordance with applicable privacy laws and will not retain it for longer than reasonably necessary for the purpose for which it was provided.

8.6

Where a monetary security deposit is required, the amount will be advised before the equipment is released.

8.7

The security deposit may be used, to the extent permitted by law, to cover:

  • loss of equipment;
  • theft or failure to return equipment;
  • damage beyond reasonable wear and tear;
  • missing accessories or components;
  • cleaning or repair costs resulting from misuse or negligence; or
  • other reasonable costs arising from a breach of the equipment hire agreement.

8.8

A customer remains responsible for equipment from the time it is provided to them until it is returned to and accepted by Dromana Drive-In.

8.9

Customers must:

  • take reasonable care of hired equipment;
  • use equipment only for its intended purpose;
  • follow any instructions provided by Dromana Drive-In;
  • not modify, dismantle or tamper with equipment;
  • not allow unauthorised persons to use the equipment where prohibited by Dromana Drive-In;
  • notify Dromana Drive-In as soon as reasonably practicable if equipment is damaged, lost, stolen or malfunctions; and
  • return the equipment and all accessories by the required return time.

8.10

The customer must not remove hired equipment from the Dromana Drive-In premises unless expressly authorised by Dromana Drive-In.

8.11

Where equipment is not returned by the required return time, Dromana Drive-In may charge reasonable additional hire, replacement, recovery or other costs to the extent permitted by law.

8.12

Where equipment is returned in satisfactory condition and all required items have been returned, any refundable security deposit will be returned in accordance with the applicable payment method and Dromana Drive-In's procedures.

8.13

If equipment is returned damaged, incomplete or otherwise not in the condition reasonably expected at the time of hire, Dromana Drive-In may retain or deduct from the security deposit an amount reasonably required to cover the relevant loss or cost, subject to applicable law.

8.14

If the cost of loss, damage, replacement, repair or recovery exceeds the security deposit, the customer may remain responsible for the reasonable balance, subject to applicable law.

8.15

Nothing in this section limits any rights or remedies available to a customer under the Australian Consumer Law or other applicable law.

8.16

Additional equipment-specific terms may apply to particular items or hire arrangements. Where additional terms are provided to the customer before the equipment is released, those terms form part of the equipment hire agreement.

 

9. Purchases & GST

9.1

Unless otherwise stated, prices displayed on our website are in Australian dollars (AUD).

9.2

Where applicable, prices include Goods and Services Tax (GST).

9.3

Where GST is applicable, the GST-inclusive price will generally be the price displayed to consumers at the point of purchase.

9.4

Additional charges, including delivery or booking fees where applicable, will be disclosed before you complete your purchase.

9.5

We may correct pricing or other errors displayed on our website.

If an item has been purchased at an incorrect price due to an obvious error, we may contact you to confirm whether you wish to proceed at the correct price or receive a refund.

9.6

Nothing in this section permits us to engage in misleading or deceptive conduct or otherwise limits your rights under applicable law.

If you do not wish to appear in promotional material, please notify a member of staff where reasonably practicable.
